RIGHT OF WITHDRAWAL POLICY

Right of Withdrawal Policy. Effective as of 18/06/2026

1. Exercise of the Right of Withdrawal

Pursuant to Article 52 et seq. of the Italian Consumer Code, the Consumer has the right to withdraw from the purchase contract within 14 (fourteen) days from the receipt of the goods (or from the receipt of the last item in case of multiple deliveries), without providing any reason and without incurring any penalty.

To exercise the right of withdrawal, the User may choose one of the following methods, provided that no procedures will be applied that make the exercise of withdrawal more burdensome than the purchase process itself:

  • Online Procedure (Recommended): Directly through the website giopiu.it, by accessing the personal account area (“Order Area”) and using the dedicated electronic function by clicking on the “Withdraw from the contract here” button, available for the entire duration of the withdrawal period.

  • Standard Withdrawal Form: By using the standard withdrawal form compliant with Annex I, Part B of the Consumer Code, to be sent to the contact details indicated at the bottom of this policy.

Following the exercise of the right of withdrawal in the manner indicated above, giopiu.it shall send the User, without undue delay, an acknowledgement of receipt on a durable medium (e-mail), containing a summary of the declaration, along with the exact date and time of transmission.

2. Register of Withdrawal Declarations (Privacy Notice)

In the event that the right of withdrawal is exercised via the online procedure, the User’s personal data (first name, last name, contract/order identification, confirmation e-mail address), together with the IP address and the date/time of transmission, will be recorded and stored in a specific unalterable digital archive.

Purposes and Legal Basis of the Processing

The processing of such data is carried out:

  1. For compliance with a legal obligation to which the Controller is subject (Art. 6, par. 1, let. c, GDPR, in conjunction with the Italian Consumer Code).

  2. For evidentiary and accountability purposes (Art. 6, par. 1, let. f, GDPR), in order to demonstrate the correct and timely exercise of the right.

Data Retention

The personal data collected for this purpose will be retained for the period necessary to protect the rights of the parties and to comply with legal obligations, which is set by default at 10 (ten) years.

3. Exceptions to the Right of Withdrawal and Proof of Consent

The User is informed that the right of withdrawal is excluded for certain categories of products and services pursuant to Art. 59 of the Italian Consumer Code (for example, custom-made or clearly personalized goods, or goods liable to deteriorate rapidly).

For services or digital content not supplied on a tangible medium where performance has begun with the consumer’s prior express consent, the right of withdrawal is lost once the service has been fully performed or the download/streaming has commenced.

Retention of Proof of Consent

At the time of ordering such specific categories of goods/services, the system will record the text of the express consent and acknowledgment of the exclusion of withdrawal provided by the User, together with the date, time and — unless deactivated by the User — the IP address.

  • Purpose: To prove the validity of the exemption from the right of withdrawal and to enable the establishment, exercise, or defense of legal claims.

  • Legal Basis: Legitimate interest of the Controller (Art. 6, par. 1, let. f, GDPR; cf. Art. 17, par. 3, let. e, GDPR).

  • Retention: Such data will be retained for the applicable statutory limitation period (10 years), after which the IP address will be permanently deleted or anonymized.

Legal Note: The express consent required at this stage under the Consumer Code is strictly intended for the validity of the commercial contract and the exemption from withdrawal, and is therefore completely separate and distinct from any consent to the processing of personal data for marketing or profiling purposes under the GDPR.

4. Rights of the Data Subject and Contact Information

At any time, the User may exercise the rights provided for in Articles 15 et seq. of the GDPR (including the right of access, rectification, erasure, and the right to object to processing pursuant to Art. 21 GDPR, compatibly with the needs of establishing, exercising, or defending rights in legal proceedings).
